NRI agrees to pay Rs 67 lakhs to wife in matrimonial dispute

A London-based NRI, accused of attempting to kill his wife in a matrimonial dispute, has been granted anticipatory bail by the Delhi High Court after he agreed to pay her the permanent alimony of Rs 67 lakhs towards her and their child's maintenance.Justice Kailash Gambhir in a recent order allowed a bail plea of Anuj Kapoor(name changed), an Indian origin British National, after he and his wife entered into an agreement and the original copy of the agreement was furnished before the court.
"In the event of arrest, the petitioner(Kapoor) shall be granted bail subject to his furnishing of personal bond in the sum of Rs 50,000 with one surety of the like amount to the satisfaction of the SHO of the concerned police station", said Justice Gambhir.
Directing the wife to co-operate, the Court asked both of them to file petitions for quashing of the FIRs lodged by her following their settlement and later they can approach the family court for mutual divorce.
The Court said Kapoor, a businessman, will deposit the amount in three instalments. Out of Rs 67 lakhs, he will deposit Rs 32 lakhs with the trial court which will hear their mutual divorce case, Rs 25 lakhs will be given by way of a demand draft and rest Rs 10 lakhs will paid by him to the wife after quashing of the criminal cases against him.
It was directed that after compliance of the court order, Kapoor will be allowed to visit abroad.
The couple's marriage took place in August 2007 and within a few months they moved to England. After the birth of their son and due to their differences the wife moved back to India.
Kapoor, in the petition, claimed he had come to India to resolve the differences with his wife but following some arguments, she filed two FIRs against him for alleged attempt to murder with Rajouri Garden police station.
